Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Longafter platform, including the website at longafter.au and any related applications or services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Longafter is an Australian product. These Terms are governed by the laws of New South Wales, Australia. Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law or any other applicable Australian law that cannot be excluded.
1.The Service
Longafter provides an AI-assisted life story and legacy planning platform. The Service allows users to capture personal memories through guided conversations, organise important information in an encrypted vault, generate written biographical content from their stories, and share selected content with nominated family members and executors.
Longafter is not a legal service, financial service, or medical service. Nothing on the platform constitutes legal advice, financial advice, a will, a testament, a legally binding instrument, a substitute for professional estate planning, or advance care documentation with legal effect unless separately verified by a qualified professional. We strongly recommend consulting a licensed solicitor for estate planning and a financial adviser for financial matters.
The Service is intended for personal, non-commercial use by individuals aged 18 and over. You must be a resident of Australia or lawfully present in Australia to use the Service, though we do not technically restrict access from other jurisdictions.
2.Accounts and Registration
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@longafter.au if you become aware of any unauthorised access to your account.
You may only hold one account. Accounts are personal and may not be transferred to another person.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or where required by law.
3.Your Content — Ownership and Licence
3.1 You own your stories
All personal content you create, upload, or share through the Service — including your written responses, voice recordings, memories, personal details, vault entries, and any other original content you provide ("Your Content") — remains your property. You retain all intellectual property rights in Your Content.
3.2 Licence to operate the Service
By using the Service, you grant Longafter a limited, non-exclusive, royalty-free, worldwide licence to store, process, and display Your Content solely for the purposes of providing the Service to you. This licence exists only to allow us to technically operate the platform — to store your stories, generate your biography, send your emails, and share content you have elected to share with family members.
This licence does not permit us to use Your Content for any other purpose, including advertising, marketing, training AI models, sale to third parties, or any use not directly required to provide the Service to you.
3.3 We will never use your content to train AI
Your personal stories, vault entries, and all content you share on Longafter will never be used to train artificial intelligence models, including Longafter's own systems or any third-party AI systems. Your memories are yours. We process them to provide the Service to you and for no other purpose.
3.4 Deletion
If you delete your account, we will delete Your Content from our systems within 30 days, except where we are required by law to retain certain records. Anonymised, aggregated usage statistics that do not identify you individually may be retained.
4.AI-Generated Content — The Biography
4.1 What the biography is
The biography feature uses artificial intelligence to synthesise Your Content into a written narrative life story ("the Biography"). The Biography is generated from your own words and memories and reflects only what you have shared with the Service.
4.2 Copyright in AI-generated content
The copyright status of AI-generated content is unsettled under Australian law and internationally. The Copyright Act 1968 (Cth) has not been amended to expressly address AI-generated works, and no Australian court has definitively ruled on whether AI-generated prose can be protected by copyright.
In light of this uncertainty, and to be transparent with you:
- —Your original stories and words — the content you provided to generate the Biography — remain your copyright.
- —Longafter does not claim copyright ownership in the AI-generated Biography.
- —We grant you a perpetual, irrevocable, royalty-free licence to use, reproduce, share, print, and distribute your Biography for personal, family, and non-commercial purposes.
- —The Biography is generated exclusively from content you provided. It does not reproduce any third-party copyrighted works.
If and when Australian copyright law is clarified with respect to AI-generated works, we will update these Terms accordingly and notify you.
4.3 Accuracy
The Biography is generated by AI and reflects the content you shared. It may contain interpretations, inferences, or narrative constructions that you wish to amend. You are solely responsible for reviewing your Biography and ensuring it reflects your wishes before sharing it. Longafter makes no warranty that the Biography is accurate, complete, or suitable for any particular purpose.
The AI may occasionally make narrative errors. If you identify content that is factually wrong or that you did not provide, please contact us and regenerate your Biography.
5.The Encrypted Vault
5.1 Zero-knowledge encryption
Vault contents are encrypted in your browser using AES-256-GCM encryption before being transmitted to or stored on our servers. Your vault password and the encryption keys derived from it are never transmitted to or stored by Longafter in usable form. This means Longafter cannot read, access, or recover your vault contents.
5.2 Your responsibility for vault access
You are solely responsible for maintaining access to your vault password and your recovery phrase. If you lose both your vault password and your recovery phrase, Longafter cannot recover your vault contents. There is no "forgot password" mechanism for the vault that would allow us or any third party to access your encrypted data.
We strongly recommend storing your recovery phrase in a secure physical location separate from your device.
5.3 Vault is not a legal instrument
Information stored in the vault — including account details, document locations, executor information, and personal wishes — is for practical reference only. It does not constitute a will, a codicil, a binding testamentary document, or any legally enforceable instrument. Executor access via the Service does not create any legal obligation or authority.
For your estate to be properly administered, you should engage a licensed solicitor to prepare a formal will and other relevant legal documents that reference, but are separate from, any information stored in your Longafter vault.
6.Family Sharing and Executor Access
You may invite other persons to access your archive as family members or in an executor role. By sending an invitation, you confirm you have the consent of the person you are inviting to share their contact details with us for the purpose of sending the invitation.
Family members and executors can only access content you have explicitly shared with them. Executor vault access is a convenience feature to assist with practical estate administration — it does not create legal authority, does not constitute appointment as a legal executor, and does not carry the responsibilities or powers of a formally appointed executor under Australian law.
You may revoke access at any time from your Family settings. On revocation, the person's access to your content will be immediately removed.
7.Subscriptions and Payments
7.1 Pricing
Longafter offers a free tier with limited features and a paid subscription ("Longafter plan") billed monthly or annually. Current pricing is displayed on the pricing page at longafter.au and within the app. Prices are in Australian Dollars (AUD) and include GST where applicable.
7.2 Biography purchase
The Biography feature requires a paid subscription and is available as a one-time additional purchase. This is a separate charge from the subscription fee. Once purchased, the Biography feature is yours to use for the lifetime of your account.
7.3 Billing
Payments are processed by Stripe. By providing payment details, you authorise Longafter to charge the applicable fees on the billing cycle you select. Subscriptions renew automatically unless cancelled before the renewal date.
7.4 Cancellation
You may cancel your subscription at any time from Settings → Billing. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the period ends. We do not provide partial refunds for unused subscription periods except where required by Australian Consumer Law.
7.5 Refunds
Under the Australian Consumer Law, you are entitled to a refund or remedy if a product or service has a major failure. If the Service fails to meet the consumer guarantees under the Australian Consumer Law, you may be entitled to a refund. Please contact hello@longafter.au to raise any such issues. We aim to resolve all complaints fairly and promptly.
Outside of statutory rights, subscription fees are generally non-refundable once a billing period has commenced. Biography purchases are non-refundable once generation has been completed.
7.6 Price changes
We may change subscription pricing with at least 30 days' notice to existing subscribers. If you do not agree to a price change, you may cancel before it takes effect.
8.Privacy and Data
8.1 Privacy Act compliance
Longafter complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Your personal information is collected, used, and stored in accordance with our Privacy Policy, which forms part of these Terms.
8.2 Data storage
Your data is stored on servers located in Sydney, Australia (Supabase ap-southeast-2 region). Application functions are processed in Sydney (Vercel syd1 region). Static assets are distributed via Cloudflare's global content delivery network; no personal data is stored in the CDN layer.
8.3 What we collect
We collect information you provide directly (name, email, story content, vault entries), information generated by your use of the Service (session metadata, usage patterns), and technical information necessary to operate the Service (IP address, device type, browser). We do not collect sensitive health information except to the extent you voluntarily include it in your stories or vault entries.
8.4 How we use it
We use your information to provide and improve the Service, send communications you have requested (weekly story prompts, monthly reflections, transactional emails), process payments, and comply with legal obligations. We do not use your personal information for advertising. We do not sell your personal information to third parties.
8.5 Third party processors
We use the following third-party services to operate the platform, each of whom processes data only as necessary to provide their service:
- —Supabase — database and authentication (Australia)
- —Vercel — application hosting and deployment (Australia functions, global CDN for static assets)
- —Anthropic — AI processing for story sessions and biography generation (United States)
- —Stripe — payment processing (United States)
- —Resend — transactional email delivery (United States)
Content sent to Anthropic for AI processing is subject to Anthropic's privacy policy and terms. We have selected Anthropic partly because they do not train on API customer data by default.
8.6 Your rights
Under the Privacy Act 1988 (Cth), you have the right to access the personal information we hold about you, request correction of inaccurate information, and make a complaint if you believe we have breached the Australian Privacy Principles. To exercise these rights, contact hello@longafter.au. We will respond within 30 days.
If you are unsatisfied with our response to a privacy complaint, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
9.Acceptable Use
You agree not to use the Service to:
- —Upload or share content that is unlawful, defamatory, harassing, or that infringes the intellectual property rights of others
- —Impersonate any person or misrepresent your identity
- —Attempt to gain unauthorised access to other users' accounts or content
- —Use automated tools, scrapers, or bots to access the Service
- —Circumvent or attempt to circumvent any security or access controls
- —Use the Service for any commercial purpose without our prior written consent
We reserve the right to remove content that violates these terms and to suspend or terminate accounts engaged in prohibited conduct.
10.Third-Party Content and Links
The Service may contain links to third-party websites or resources. These are provided for convenience only. Longafter has no control over and assumes no responsibility for the content, privacy policies, or practices of third-party sites.
11.Disclaimers and Limitation of Liability
11.1 Service availability
Longafter provides the Service on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We may modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice where practicable.
11.2 No warranty on AI content
AI-generated content, including story session responses and the Biography, is provided for informational and personal purposes only. It may contain errors, omissions, or inaccuracies. Longafter makes no warranty as to the accuracy, completeness, or fitness for purpose of any AI-generated content.
11.3 Limitation of liability
To the maximum extent permitted by law, Longafter's total liability to you for any claims arising from your use of the Service is limited to the amount you paid to us in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Australian law, including the consumer guarantees under the Australian Consumer Law.
11.4 Data loss
While we take reasonable measures to protect your data, we cannot guarantee against data loss in all circumstances. You are encouraged to maintain your own copies of important information stored in the vault. Longafter will not be liable for loss of encrypted vault data where such loss results from your loss of your vault password and recovery phrase.
12.Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email and by displaying a notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.
If you do not agree to updated Terms, you may close your account before they take effect.
13.Governing Law and Disputes
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the non-exclusive jurisdiction of the courts of New South Wales.
